What changes in legislation await Uzbeks from July 1?

From July 1, Uzbekistanis will have not only hot days, but also numerous changes in legislation. They will touch on a number of social aspects:

1. The procedure for registering self-employed persons is simplified

List of activities (works, services) that self-employed persons can engage in expands up to 67 species.

Registration of self-employed persons is carried out on a notification basis through a special mobile application or the personal account of the taxpayer with the issuance of a matrix bar code (QR code) confirming the fact of registration as a self-employed.

Self-employed persons pay social tax for 2020 in the amount of at least 50% of the BRV amount, regardless of the actual hours worked as a self-employed person

2. Organizations building multi-storey buildings are provided with customs privileges

In the period from July 1, 2020 to July 1, 2023, imported forms for pouring concrete, machines and mechanisms for preparing concrete for the construction of multi-storey monolithic residential buildings are exempt from customs payments (except for value added tax and customs clearance fees) according to the list formed in established okay.

Payers of customs payments in the period from July 1, 2020 to July 1, 2023 are entitled to a deferral of up to 120 days or an installment plan for the payment of customs payments (excluding value added tax and customs clearance fees) on imported machinery and equipment used in the construction industry , technological equipment, means of small mechanization, instruments, spare parts and accessories.

3. A mediator service is being introduced for citizens at the Central State University of Tashkent

4. The system of environmental protection and social management is being introduced during the construction of apartment buildings.

Starting July 1, 2020:

• The Council of Ministers of the Republic of Karakalpakstan and regional khokimiyats will allocate land plots for housing construction if they are not irrigated land and are not part of the forest fund, as well as if there is no threat of forced eviction of the population;

• representatives of the territorial departments of the Uzhydromet Center are included in the composition of the commission considering the issues of provision (sale) of land plots and their opinion is taken;

• investment agreements will be concluded with entrepreneurs who have won the tender for the construction of apartment buildings in rural areas;

• a conclusion on the environmental impact of the allocated land tracts (plots) for the construction of residential buildings and local drainage treatment facilities will be prepared, as well as the conclusions of the state ecological expertise will be submitted by the territorial departments of the State Committee on Ecology and Environmental Protection;

• in the process of construction of apartment buildings, in accordance with the requirements of international financial institutions, a system of environmental protection and social management is being introduced.

5. An additional salary increase is established for employees of citizens’ self-government bodies

To the official salary of employees of citizens’ self-government bodies will be paid additional a surcharge of 30 percent.

6. The procedure for licensing publishing activities is canceled

A system of notification of the start of publishing and printing activities is being introduced, with the abolition of the procedure for issuing permits for licensing publishing activities, as well as the procedure for issuing permits for implementation printing activity.

7. Legal rules providing for liability will be established exclusively by laws.

Starting out from July 1 this year:

• it is prohibited to regulate issues falling within the powers of economic management bodies and corporate relations by adopting by-laws or through administrative methods;

• legal norms providing for liability for individuals and legal entities are established exclusively by laws;

• it is not allowed to include in departmental regulatory legal acts legal norms establishing additional payments and fees for individuals and legal entities, providing for unnecessary administrative and other restrictions that lead to the formation of unreasonable costs for them, having a permissive nature;

• inclusion of legal norms in normative acts in the field of technical regulation is not allowed;

• normative acts in the field of technical regulation are subject to mandatory legal examination by the Ministry of Justice;

• a “package” principle is being introduced, which provides for the introduction of conceptually new mechanisms in the preparation of draft regulations;

• in order to systematize legislation and reduce unnecessary legal regulation in the period from July 1, 2020 to January 1, 2021, the adoption of departmental regulatory legal acts is suspended (except for the adoption of departmental regulatory legal acts on amendments and additions and recognition as invalid, as well as providing for their unification).

8. The procedure for hearing information from the heads of state bodies and economic management bodies is being introduced into practice

Introduced into practice order regular hearing at meetings of the Legislative Chamber of the Oliy Majlis of information from the heads of state bodies and economic management bodies about their activities, as well as members of the Government and industry leaders about the work being done to implement the UN Sustainable Development Goals, the development of science, education and the digital economy.

9. The construction control inspectorate is granted additional authority

The heads of the Construction Control Inspectorate and Territorial Inspectorates are empowered to consider cases of administrative offenses for violations of the legislation on urban planning while maintaining order transfer of the case for consideration to the court in case the offender contested the fact of the offense.

10. A system of reference pricing for medicines is being introduced

A system of reference pricing for medicines is being gradually introduced domestic and foreign production.

Accordingly, at least 10 reference countries are selected from the group of countries with high, above average or below average per capita income.

The maximum prices for each trade name of the medicinal product are registered, taking into account the dosage form, the number of units in the package, dosage, concentration, volume and packaging. At the same time, the supply of a drug to the Republic of Uzbekistan (for imported drugs) and release by a domestic manufacturer (for domestic drugs) above the established price is not allowed.

Also, in all medical organizations of the republic, regardless of the form of ownership, a mandatory procedure for issuing prescriptions exclusively for the international nonproprietary name of drugs is being introduced.

In addition, the “Mystery Buyer of Pharmaceutical Products” institute is being introduced.

One of the main tasks of this institute is to monitor and assess compliance by medical organizations and pharmacies, regardless of the form of ownership, the requirements of the legislation governing the procedure for prescribing prescriptions and setting price caps for the trade name of a medicinal product.

11. All obstetric facilities will have an Electronic Birth and Death Data Exchange Program

In all obstetric care facilities, regardless of ownership and departmental affiliation, the maintenance of the Electronic Data Interchange Program is compulsory.

12. The facts of detention of a person will be entered into a single electronic registration system

Facts application procedural coercive measures restricting rights, including the detention of a person, will be entered into a unified electronic registration system.

13. An electronic rating of design and survey organizations is being introduced

An electronic rating of design and survey organizations, automatically generated according to tax and statistical reporting data (work experience, number of employees, including qualified ones, amount of fixed assets, income received and taxes paid, wages fund and other criteria)

14. Tax incentives for private museums, art galleries and handicraft centers

From July 1, 2020 to July 1, 2023, the rates of income tax, property tax, land tax and turnover tax for the main activity of non-state (private) museums, art galleries and handicraft centers are reduced by 50 percent of established pond.
