The Committee on Defense and Security of the Legislative Chamber studied the issues raised in the appeal and social networks, which came to the web portal “My opinion” in connection with the entry of the car into the penalty area.
The current Code of Administrative Liability provides for the maintenance of vehicles in the absence of insurance of the vehicle or in the absence of its provision by the owner to the traffic police officer.
We are also studying the experience of foreign countries in this regard. In particular, in the states of North Carolina, Virginia, Mississippi, Germany, England, Italy, France, the Russian Federation, there are administrative penalties for compulsory insurance of civil liability in the absence of insurance policies.
Thus, in foreign practice, in the absence of insurance policies for compulsory civil liability insurance, it can be seen that the right of citizens to property is guaranteed by imposing administrative fines.
In conclusion, it should be noted that the vehicle is the personal property of a physical person, and its confiscation or temporary detention is a restriction of the owner’s right to property. “Therefore, if there are no or no insurance policies for compulsory civil liability insurance, it is time to abolish the requirement to take the vehicle to the penalty area and impose a fine on the spot,” he said.
According to Farhod Ashmatov, the proposal is currently being studied by experts and a law is expected to be adopted soon.
